This privacy policy (“Privacy Policy”) is between you- the doctors/ healthcare professionals (“you”, “your” or “User”) and Apollo Healthco Limited, a company duly incorporated under the provisions of the Companies Act, 2013, having its registered office at 19, Bishop Gardens, R A Puram, Chennai, Tamil Nadu - 600028, India (“AHL”, “we”, “us” “Our”) which is the operator of the Clinical Intelligence Engine (“CIE”) accessed through AHL’s website at www.ciengine.com (“Platform”), which is also referred in the terms and conditions of the Platform (“Terms and Conditions”).

We value our Users’ privacy. This Privacy Policy is effective from the date you agree to the Terms and Conditions by click through; it summarizes what information we might collect from a User and what we will and will not do with it. Please read this Privacy Policy carefully and note that by continuing to use the services or accessing the Platform(s) you agree to this Privacy Policy. By accepting this Privacy Policy, you represent that you are eighteen [18] years of age or above and that you expressly agree to the collection, storage, processing, disclosure and/or transfer, and use of your Personally Identifiable Information (as defined below) according to terms set out hereunder.

  1. “Personally Identifiable Information” means information that can be used to identify you as an individual, such as, for example: your name, company, email address, phone number, your address, your user ID and password (if applicable), your payment information (if applicable); any account-preference information you provide us; your computer’s domain name and IP address, and session data for your login session, so that our computer can ‘talk’ to yours while you are logged in.
  2. Collection of Personally Identifiable Information: When you use our Platform(s), we collect and store your Personally Identifiable Information as provided by you from time to time. We may collect Personally Identifiable Information from you in a variety of ways, including, but not limited to, when Users visit our Platform(s), register on the Platform(s), during your use of the CIE and in connection with other activities, services, features or resources we make available on our Platform(s).
  3. You undertake that you shall be solely responsible for the accuracy and truthfulness of the Personally Identifiable Information you share with us, and that AHL will not be responsible for ensuring the authenticity of your Personally Identifiable Information. You may choose to request access for reviewing your Personally Identifiable Information and request any modification or amendment of your Personally Identifiable Information by writing to AHL’s grievance officer (“Grievance Officer”) at the contact details mentioned in this Privacy Policy.
  4. What we do with your Personally Identifiable Information: It is always up to you whether to disclose Personally Identifiable Information to us, although if you elect not to do so, we reserve the right not to register you as a user or provide you with access of the Platform. We may use your Personally Identifiable Information for purposes including but not limited to the following purposes:

    • To personalize User experience;
    • To improve our Platform(s), products and services we offer;
    • To improve customer service;
    • To send you information and updates pertaining to our services;
    • To send periodic emails in the form of a newsletter, updates about our products or other promotions. Email unsubscribe instructions will be included at the bottom of each email or the User may contact our support team;
    • To contact you via email or phone on your contact details provided to offer you information and services pertaining to the product you have opted for.

    You agree and acknowledge that collection of your Personally Identifiable Information is necessary for the purposes above and the collection of the same is in furtherance of a lawful purpose.

  5. If you do provide Personally Identifiable Information to us, we will not sell it to a third party without your permission — although unless you opt out (see below), we may use your contact information to provide you with information we believe you need to know or may find useful, such as (for example) news about our services and products and modifications to the Terms and Conditions.
  6. You give your consent to use or disclose your Personally Identifiable Information:

    • as necessary to provide services or use of the Platform;
    • in other ways described in this Privacy Policy or to which you have otherwise consented;
    • in the aggregate with other information in such a way so that your identity cannot reasonably be determined (for example, statistical compilations);
    • as required by law, for example, in response to a court order or search warrant;
    • to outside auditors;
    • as necessary to enforce the Terms and Conditions;
    • as necessary to protect the rights, safety, or property of AHL, its users, or others; this may include (for example) exchanging information with other organizations for fraud protection and/or risk reduction.
  7. Other information we collect: We may collect other information that cannot be readily used to identify you, such as (for example) the domain name and IP address of your computer or any other device through which you will login. We may use this information, individually or in the aggregate, for technical administration of our Platform(s); research and development; customer and account administration; and to help us focus our marketing efforts more precisely.
  8. Cookies: AHL uses ‘cookies’ to store personal data on your computer. We may also link information stored on your computer in cookies with personal data about specific individuals stored on our servers. If you set up your web browser (for example, Internet Explorer or Firefox) so that cookies are not allowed, you might not be able to use some or all of the features of our Platform(s).
  9. External data storage sites: We may store your Personally Identifiable Information and data on servers provided by third party hosting vendors with whom we have contracted.
  10. Your privacy responsibilities: To help protect your privacy, be sure:

    • not to share your user ID or password with anyone else;
    • to take customary precautions to guard against “malware” (viruses, Trojan horses, bots, etc.), for example by installing and updating suitable anti-virus software.
  11. Retention of Personally Identifiable Information: We will retain your Personally Identifiable Information for as long as necessary for the purposes described above and for providing our services. We may also retain and use your Personally Identifiable Information for such period as is necessary to comply with applicable laws in India (“Applicable Laws”), fulfil our legal obligations, resolve disputes, and enforce our agreements.
  12. Protection of your Personally Identifiable Information: We have adopted reasonable security practices, including physical, managerial, operation and technical security measures to protect against unauthorized access, alteration, disclosure or destruction of your Personally Identifiable Information and data stored by AHL, as required under Applicable Laws.
  13. Sharing your Personally Identifiable Information: AHL does not sell your Personally Identifiable Information to any third party for any purpose whatsoever. Keeping this in mind, we may disclose, transfer and/or share your Personally Identifiable Information with certain persons, including persons outside India, for the following cases:

    • To our partners, affiliate entities, employees, consultants, contractors, independent service providers and other third-parties and persons who are bound by contractual obligations to keep User’s Personally Identifiable Information confidential and use it only for the purposes for which we disclose it to them, namely for providing our services or to assist us with our operating the Platform(s).
    • To our affiliates, subsidiaries, group companies, related parties and other assigns to allow them to provide support services and technical services to us and to receive some of these services from them and to provide support services and technical services to them and to offer their products and services to you including offering combined products and services.
    • For administering activities such as detection of identity theft, fraud and other potentially illegal acts, to facilitate joint or co-branded services that you request where such services are provided by more than one corporate entity. We may share your information with these third parties for those limited purposes provided that you have given us your permission.
    • We may disclose Personally Identifiable Information if required to do so by law or in the good faith belief that such disclosure is reasonably necessary to fulfil our obligations under any Applicable Laws or enforce our legal rights, pursue our legal remedies, respond to subpoenas, court orders, or any other legal process.
    • For any other purpose in connection with the purposes above.
    • Other than as prescribed under this Privacy Policy, we will not disclose any User’s Personally Identifiable Information to any external organization unless (i) we have obtained the consent of the User; or (ii) we are required by law to provide such information.

      Notwithstanding anything mentioned hereinabove, AHL shall not be responsible for the actions or omissions of the service providers or parties with whom the Personally Identifiable Information is shared, nor shall AHL be responsible and/or liable for any additional information you may choose to provide directly to any service provider or any third party.

  14. Changes to this Privacy Policy: We reserve the right to change this Privacy Policy with notice as we deem necessary or appropriate because of legal compliance requirements or changes in our business practices and will communicate the same to you. We also encourage you to frequently check our Platform(s) for any change in this Privacy Policy.
